Bill proposes request consensual separation and divorce by electronic

Senator Patricia Saboya proposed Bill which aims at PLS 464/2008 using electronic means for purposes of solicitation of consensual separation and divorce, where there is minor or incompetent children of the couple. This is a great initiative provided from the enactment of Law 11419/2006, aiming to expand the proceeding that until then were restricted to the rite and could face if approved the current wording, to provide faster fulfillment of this formality.

Since 07/04/2009 the day, the project is on the Committee on Constitution, Justice and Citizenship with the rapporteur of the Senate Senator Serys Slhessarenko to issue report.

Take down the content of the PLS 464/2008

Adds art. 1124-B to Law No. 5869 of January 11, 1973 (Code of Civil Procedure), to authorize applications for separation and divorce through electronic means.

THE NATIONAL CONGRESS decrees:

Law No. 5869 of January 11, 1973 (Code of Civil Procedure), comes into force with the following article:

The separation consensual and divorce consensual, with no minor or incompetent children of the couple, and observed the legal requirements regarding deadlines, may be required, the competent court, electronically, according to the provisions of Law No. 11,419 of December 19, 2006 , which provides for the computerization of the judicial process.

The petition shall contain the provisions to express and share the common property, to alimony and names, if you have changed with marriage.
